Terms of Service

1. Agreement

These Terms of Service (the “Terms”) govern your access to and use of the CapyKids daycare management platform, including our web dashboard, mobile applications, and related services (collectively, the “Service”). By creating an account, accepting an invitation, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a daycare or other organization (the “Organization”), you represent that you are authorized to bind that Organization to these Terms.

2. Accounts and roles

The Service supports several roles, including daycare administrators, teachers, billing staff, and parents/guardians. Access to data is scoped to your role and to the Organization you belong to. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

  • Access data belonging to children, families, or organizations you are not authorized to access.
  • Attempt to probe, scan, or circumvent the Service’s authentication, tenant isolation, or security controls.
  • Upload unlawful, harmful, or infringing content, or content you lack the right or consent to share.
  • Use the Service to send spam or to harass others.
  • Interfere with or disrupt the integrity or performance of the Service.

4. Children’s information

The Service is designed for use by childcare providers and the families they serve. Information about children is provided to us by the Organization and by parents/guardians who use the Service. Organizations are responsible for obtaining any consents required by applicable law (including the Children’s Online Privacy Protection Act where it applies) before submitting a child’s information or capturing photos. Photo features are gated on recorded consent, and consent may be revoked at any time. See our Privacy Policy for how this information is handled.

5. Payments

Payments — including platform subscription fees, tuition, waitlist fees, and add-on charges — are processed by our payment provider, Stripe. We do not store full card or bank account numbers. Your use of payment features is also subject to Stripe’s terms. Fees are described at the point of purchase or in your Organization’s billing settings. Except where required by law or expressly stated, fees are non-refundable.

6. Customer data and ownership

As between you and CapyKids, your Organization retains all rights to the data it submits to the Service (“Customer Data”). You grant us a limited license to host, process, and transmit Customer Data solely to provide and support the Service. We process Customer Data in accordance with our Privacy Policy.

7. Service availability and changes

We work to keep the Service available and reliable, but we provide it on an “as is” and “as available” basis. We may modify, suspend, or discontinue features from time to time. We will use reasonable efforts to notify Organizations of material changes that adversely affect their use.

8. Suspension and termination

We may suspend or terminate access for an account or Organization that violates these Terms, fails to pay applicable fees, or poses a security or legal risk. You may stop using the Service at any time. On termination, we will handle Customer Data as described in the Privacy Policy and applicable law.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, CapyKids disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. CapyKids will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to the Service. Our aggregate liability is limited to the amounts paid for the Service in the twelve months preceding the claim.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Continued use after changes take effect constitutes acceptance.
